
LIL & BLUE SELF-DRIVE CLASSIC CAR HIRE TERMS AND CONDITIONS
1. Definitions
In these Terms and Conditions:

"Company" means Lil & Blue
-
"Customer" means the person named in the Rental Agreement.

"Vehicle" means the classic motor vehicle hired by the Customer.

"Rental Period" means the period specified in the Rental Agreement.
-
"Rental Agreement" means the booking confirmation and these Terms and Conditions.
-
"Authorised Driver" means a driver approved by the Company and named in the Rental Agreement.
2. Eligibility to Hire
2.1 The Customer and any Authorised Driver must:

Be aged 25 years or over.
-
Hold a full UK driving licence or equivalent licence accepted by the Company's insurers.
-
Have held a full driving licence for a minimum of five (5) years.
-
Meet the Company's insurance criteria at the time of hire.
-
Produce such documentation as reasonably required by the Company, including driving licence, proof of identity and proof of address.
2.2 The Company reserves the right to refuse any hire where insurance approval cannot be obtained or where the Company reasonably believes the Vehicle may be placed at risk.
3. Booking and Payment
3.1 A booking is confirmed only upon receipt of the required deposit.
3.2 Full payment must be received no later than fourteen 30 days before the commencement of the Rental Period unless otherwise agreed.
3.3 Failure to make payment by the due date may result in cancellation of the booking.
4. Security Deposit
4.1 A refundable security deposit of £900 shall be paid before collection of the Vehicle.
4.2 The Company may retain all or part of the security deposit to cover:

Damage to the Vehicle.

Insurance excesses.
-
Missing accessories, keys or documentation.
-
Excess mileage charges.
-
Refuelling charges.
-
Cleaning charges.
-
Administrative costs arising from breaches of this Agreement.
-
Unpaid penalties, fines, tolls or charges.
4.3 Any balance of the security deposit shall normally be refunded within seven (7) days of the Vehicle being returned and inspected.
5. Mileage Limit
5.1 The hire includes a mileage allowance of one hundred (100) miles per day.
5.2 Where the Rental Period exceeds one day, the total mileage allowance shall be calculated by multiplying the number of hire days by one hundred (100) miles.
5.3 Additional mileage will be charged at £1 per mile unless otherwise stated in writing.
5.4 The odometer reading recorded by the Company shall be conclusive evidence of mileage travelled.
6. Insurance
6.1 The Vehicle is insured subject to the terms, conditions and limitations of the Company's motor insurance policy.
6.2 The Customer shall be liable for the applicable insurance excess of £1500 in respect of any claim.
6.3 Insurance cover may be invalidated where the Vehicle is used:

Contrary to these Terms and Conditions.

By an unauthorised driver.
-
While under the influence of alcohol or drugs.
-
For racing, speed testing or competition purposes.
-
In a reckless or negligent manner.
6.4 Where insurance is invalidated through the actions of the Customer or Authorised Driver, the Customer shall be responsible for all resulting losses and liabilities.
7. Collection and Return
7.1 The Customer shall inspect the Vehicle upon collection and sign a vehicle condition report.
7.2 The Vehicle shall be returned:

On the agreed date and time.
-
To the agreed location.
-
In substantially the same condition as supplied, fair wear and tear excepted.
-
With the agreed fuel level.
-
With all keys, documents and accessories supplied.
7.3 Late returns will incur an additional hire charge of £50 per hour and may invalidate insurance cover.
8. Permitted Use
The Vehicle may only be used:
-
For private leisure purposes.
-
On public roads within England, Scotland and Wales unless otherwise agreed in writing.
-
By an Authorised Driver.
9. Prohibited Use
The Vehicle must not be used:
-
For motorsport, racing, rallies, track days or speed events.
-
For commercial hire or reward.
-
For courier or delivery services.
-
For driver training.
-
For towing.
-
Off-road.
-
Outside Great Britain without prior written consent.
-
For any unlawful purpose.
10. Care of the Vehicle
10.1 The Customer acknowledges that the Vehicle is a classic motor vehicle and may require greater care and attention than a modern vehicle.
10.2 The Customer agrees to:

Follow all operating instructions provided.
-
Check oil, coolant and fuel levels if requested.
-
Secure the Vehicle whenever unattended.
-
Take reasonable precautions against loss, theft and damage.
10.3 Smoking, vaping and the carriage of animals inside the Vehicle are prohibited unless expressly agreed in writing.
10.4 The Customer shall be responsible for the cost of repairing any damage resulting from misuse, negligence or failure to follow operating instructions.
11. Mechanical Failure and Breakdown
11.1 The Customer must immediately notify the Company of any mechanical fault, warning light, accident or breakdown.
11.2 No repairs shall be undertaken without the Company's prior approval except where immediate action is required to prevent further damage.
11.3 The Company will use reasonable endeavours to provide roadside assistance but does not guarantee a replacement vehicle.
11.4 The Customer shall not abandon the vehicle unless consent is given by the company
12. Accidents, Loss and Theft
12.1 Any accident, theft, loss or damage must be reported to the Company immediately and, where appropriate, to the police.
12.2 The Customer shall:

Obtain names, addresses and registration details of all parties involved.
-
Cooperate with insurers and the Company.
-
Not admit liability to any third party.
12.3 Failure to comply with this clause may result in the Customer becoming liable for losses not recoverable under the insurance policy.
13. Penalty Charges and Traffic Offences
13.1 The Customer shall be responsible for all:
-
Parking penalties.
-
Speeding offences.
-
Congestion charges.
-
Toll charges.
-
Clean Air Zone charges.
-
Low Emission Zone charges.
-
Any other motoring penalties incurred during the Rental Period.
13.2 The Company reserves the right to charge an administration fee of £50 plus VAT per notice received.
14. Fuel
14.1 The Vehicle shall be returned with the same fuel level as at collection unless other arrangements have been pre agreed.
14.2 If the Vehicle is returned with less fuel, the Company may charge for replacement fuel together with an administration charge.
14.3 The Customer shall be liable for all costs arising from the use of incorrect fuel.
15. Cancellation Policy
15.1 Customer cancellations:

More than 30 days before hire: refund of monies paid less the deposit.
-
Less than 30 days before hire: no refund.
15.2 The Company reserves the right to cancel a booking due to circumstances beyond its reasonable control, including mechanical failure, accident damage, theft or force majeure.
15.3 In such circumstances the Company's liability shall be limited to refunding monies paid by the Customer.
16. Limitation of Liability
16.1 Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence.

Fraud or fraudulent misrepresentation.
-
Any liability that cannot legally be excluded under English law.
16.2 Subject to clause 16.1, the Company's total liability shall not exceed the total hire charges paid by the Customer.
17. Data Protection
17.1 Personal data shall be processed in accordance with applicable UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
17.2 The Company may share information with insurers, claims handlers, law enforcement agencies and regulatory authorities where necessary.
18. Consumer Rights
18.1 Nothing in these Terms affects the Customer's statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
19. Governing Law and Jurisdiction
19.1 These Terms and Conditions shall be governed by the laws of England and Wales.
19.2 The courts of England and Wales shall have exclusive jurisdiction to hear any dispute arising from these Terms and
Conditions.
20. Acceptance
By completing a booking, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
